Encroachment permit for crane placement in the ROW on Ash and Juniper. The following insurance is required for this permit: 1. Commercial General Liability including Riggers Liability with minimum limits of $1,000,000 per occurrence, $1,000,000 personal & advertising injury, $2,000,000 general aggregate per project, $2,000,000 products/completed operations aggregate and $1,000,000 Riggers Liability. 2. Auto liability coverage for any auto with minimum limits of $1,000,000 combined single limit each accident. 3. Excess liability with minimum limits of $5,000,000 per occurrence and $5,000,000 aggregate. 4. The Town of Gilbert shall be additional insured on the commercial general liability, auto liability and excess liability policies. 5. The commercial general liability, auto liability, excess liability and workers compensation policies shall waive subrogation against the Town of Gilbert. 6. The commercial general liability and auto liability policies shall be primary and non-contributory in favor of the Town of Gilbert. 7. The excess liability policy shall follow form over the commercial general liability, including riggers liability, automobile liability and employer’s liability policies. 8. Contractors equipment coverage with actual cash valuation clause. 9. If the Contractor fails to remove the encroachment by the expiration date on the permit, the Contractor shall pay to the Town of Gilbert the sum of $1,000 per day for each calendar day past the expiration date until the encroachment is removed, as liquidated damages not penalties. The actual damages likely to result from a delay are difficult to estimate accurately and that this daily amount represents a reasonable forecast of the actual damages the Town of Gilbert will incur.
